Update
(January 22, 2013)
The mediator, the Hon. Warren K. Winkler, has announced another extension to the mediation
The extension follows meetings in Toronto during the week of January 14 to18, 2013.
That session was extended to January 22, 2013 with the participants communicating by e-mail, telephone and conference calls.
That process continues during the current extension.
The Toronto meeting was attended by about 120 representatives from the major shareholder groups made up of counsel and advisors.
During August, September and October, Chief Justice Winkler held a series of intensive meetings with the stakeholder
groups and received settlement proposals that he reviewed with his advisors. During those meetings,
the Chief Justice asked questions of each stakeholder group, and requested that each provide a confidential settlement proposal.
At that stage, he determined that it would be productive to bring representatives from all the stakeholder groups together for
a mediation session.
Earlier, Chief Justice Winkler and his team announced with great sadness that Randy Bennett, the lead counsel in this mediation, passed
away suddenly on January 3, 2013 following a heart attack. Notice of Randy's death and memorial information can be found
here.
Chief Justice Winkler asked Paul Le Vay to assume the role of lead counsel.
The purpose of this posting is to provide some insight into the procedure adopted by the mediator and his team.
